Consultation Terms Of Service

1. Introduction

These Terms of Service ("Terms") govern the fashion consulting services ("Services") provided by Smart Pattern Making ("Company," "we," "us," or "our"). By purchasing any of our consulting packages, you ("Client," "you," or "your") agree to these Terms. Please read them carefully before engaging with our Services.

2. Consulting Packages and Pricing

Choose the package that best fits your needs and start your journey to success:

Starter Package: 1-Hour Consultation - $499.99
- Includes one 1:1 video/audio call to discuss your business needs and develop actionable strategies.
Professional Package: 2-Hour Consultation - $799.99
- Includes two 1:1 video/audio calls to dive deeper into your challenges and provide ongoing support.
Expert Package: 3-Hour Consultation - $999.99
- Includes three 1:1 video/audio calls spread over two weeks, offering continuous guidance and feedback.
Elite Package: 4-Hour Consultation - $1,399.99
- Includes four 1:1 video/audio calls over a month, offering in-depth coaching across various aspects of your business.

3. Limited Time Offer

Only for the first 100 clients: For a limited time, the first 100 clients to book an appointment using our new scheduling app will receive an exclusive 15-minute consultation for just $129.99 This offer is available on a first-come, first-served basis and is limited to the first 100 bookings. After these slots are filled, the standard consulting packages (starting with the Starter Package) will be the only options available. This limited-time offer provides an opportunity to receive expert guidance at an incredible value, so don't miss out!

4. Scheduling and Communication

Consultation services will be scheduled at a mutually agreed time between all parties. The method of communication (e.g., video conference, phone call, or in-person meeting) will be specified prior to each planned session. In the event that either party needs to reschedule, a notice of rescheduling must be sent via e-mail to the other party at least 24 hours in advance.

5. Payment Terms

All consulting packages, including the limited-time offer, must be prepaid in full before the commencement of services. Once the purchase is made, no refunds will be issued. Unused consulting hours are non-refundable and non-transferable. All consulting packages must be used within the time frame specified for each package. By purchasing a package, you agree to be governed by the general Terms and Conditions of SmartPatternMaking.com.

6. Liability Disclaimer

Smart Pattern Making, including all subsidiaries and company representatives, is not legally liable for any advice or consultation provided, whether written or verbal. The decision to act or not act on any given advice is at the sole discretion of the client. SmartPatternMaking.com will not be held responsible for any outcomes resulting from the implementation or non-implementation of the advice provided.

7. Limited Scope of Engagement

At this time, the client has chosen not to hire or retain the Company for ongoing services but has requested a consultation to discuss matters relevant to the client’s business, including full package pattern making and design services. Should the client decide to engage the Company for additional services, a separate Fee Agreement will need to be signed. Until such an agreement is executed, the Company will provide no services beyond the initial consultation. The consultant-client relationship established is limited to the duration of the consultation only.

8. Appointment Cancellation Policy

When you schedule an appointment, that time is reserved exclusively for you. We do not double-book appointments to prevent disruptions due to last-minute cancellations. Therefore, a 24-hour cancellation notice is required. Cancellations must be sent via e-mail to (alejandro@smartpatternmaking.com) with the subject line “ATTN: Alejandro Esparza.” If you cancel your appointment less than 24 hours in advance, you will be charged the full fee for your appointment. No exceptions will be made.

9. Confidentiality

Both parties agree to keep all information shared during consultations confidential. This includes, but is not limited to, business strategies, financial information, and proprietary processes. The obligation of confidentiality does not apply to information that is publicly known or later becomes publicly known through no breach of this agreement.

10. Intellectual Property

All materials, methodologies, and content provided during consultations are the intellectual property of Smart Pattern Making. The Client is granted a limited, non-exclusive, non-transferable license to use the materials provided for their personal business use only. Any reproduction, distribution, or modification of these materials without express written consent from the Company is prohibited.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of [California], without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in [Los Angeles], and the parties hereby consent to the personal jurisdiction and venue therein.
